Action against AIDS Germany organized an international conference in Berlin: 10 years after the 2001 “Doha Declaration on the TRIPS Agreement and Public Health” – Has the access to medicine been improved through or despite the new World Trade Organization framework?
The 2001 „Doha Declaration on the TRIPS Agreement and Public Health“ reaffirms the right of the WTO member states to interpret and implement the TRIPS Agreement to protect public health and to enhance access to medicines. In particular, it confirms the member states’ right to issue compulsory licenses. 10 years after adopting the Doha Declaration, the Doha+10 Conference assessed if these goals have been achieved.
The conference brought together national and international stakeholders from the development cooperation, humanitarian aid, civil society, politics, academia and the pharmaceutical industry to analyse experiences of key countries (Brazil, India, Kenya and Thailand), to critically look at bilateral and regional trade agreements and to discuss alternatives and perspectives concerning innovation and access to essential pharmaceutical products. The federal government of Germany must ensure that this year's replenishment conference of the Global Fund against AIDS, malaria and tuberculosis at the beginning of October 2010 will be success. This presupposes that Germany distances itself from its own plans to reduce Germany's funding of the Global Fund. This was demanded by the Association of German Development NGOs (VENRO) and Action against Aids Germany.
Civil society organizations protested on 9-15th September jointly before the Federal Chancellery in Berlin against the planned cuts. "A reduction of the German contribution to the Global Fund is not acceptable. That would mean a severe setback for the international HIV / AIDS fight,"said Sonja Weinreich, spokeswoman for the VENRO section health. Patent Pools: Feasible Solution to the Patent Dilemma
A patent pool is created when a number of patent rights, held by differentowners, are brought together (or pooled) and made available on anon-exclusive basis. Third parties like generic manufacturers of medicines can then make use of the patents against the payment of a royalty. Such a scheme allows easier access to many patents at once as it serves as a “one-stop-shop” for all involved.
